da Vinci Lawsuits Continue to be Signed up by Law Firms Due to Recalls and Complications, Says Lawsuitsettlementnews.com

SAN FRANCISCO, Dec. 4, 2014 /PRNewswire/ -- MT Services LLC, a Lawsuit Settlement News Reporting Company which operates lawsuitsettlementnews.com, announced today a prime focus on assisting plaintiffs who have dealt with complications due to Intuitive Surgical System's da Vinci robot. It is estimated that the da Vinci machine is used in nearly 400K surgeries each year. Many patients who have undergone these types of surgeries have dealt with complications such as: lacerations to internal organs (including intestines), burns to internal organs and blood vessels, excessive bleeding, nerve damage, severe bowel injuries, punctured blood vessels or ureters, various vaginal injuries, and even death. There have been many lawsuits filed against Intuitive Surgical Inc., though at this time there is no specific number. The lawsuits have undoubtedly stemmed from reported injuries such as those listed above as well as others not listed. Intuitive Surgical Inc. reported in SEC 10-K filings that they have reserved $67MM to defend and settle some product liability claims in regards to the robotic surgery. Global settlement discussions haven't been reported yet, but according to industry experts, it is anticipated that some cases have actually settled privately. Many industry experts predict that cases with serious injuries and need for additional corrective surgeries could reach as high as $300-$500K per case.

Chris Janish, CEO of MTS, commented on the da Vinci lawsuits, "The da Vinci mass tort litigation is one that we have been actively following. Intuitive has already committed $67MM to defend the suit and it is expected that this number could increase with their year-end filing, with a larger 'write down.' We have also obtained information from sources close to the litigation that the company has already begun to settle some cases privately at lower settlement values to avoid litigation. Lastly, the company has also agreed to a 'tolling agreement' which will make the total number of filed claims tough to figure since the tolling agreement allows the plaintiff not to have to file suit and not be penalized for any statute of limitation issues. For all of these reasons, we believe this litigation is one that will continue to grow in size in 2015, and patients who were possibly harmed by a da Vinci robot surgery should seek immediate legal consultation."

Stryker Hip Recall Products (Rejuvenate and ABG II) Settle for $1 Billion; Largest Individual Base Payment Awards to Date in Mass Tort Hip Implant Settlement, Says Lawsuitsettlementnews.com

HACKENSACK, N.J., Nov. 14, 2014 /PRNewswire/ -- MT Services LLC, a Lawsuit Settlement News Reporting Company which operates lawsuitsettlementnews.com, announced today a prime focus on assisting plaintiffs who have suffered with complications from a Stryker hip implant due to the $1 billion settlement that was announced last week by Stryker Corporation. People who have received the Stryker Rejuvenate and ABG II hip replacement devices and subsequently had them removed are qualified to participate in the settlement, which was reached in State Superior Court in Hackensack, New Jersey and in Federal Court in Minnesota. However, those who sued prior to device failure without replacement surgery before November 3rd are not eligible to partake in the settlement, but according to lawyers in NorthJersey.com, they "could be covered in a future round of negotiations" with Stryker Corp.

In July of 2012, the Rejuvenate and ABG II implant devices were recalled by Stryker and its subsidiary Howmedica Osteonics Corp., during which time unusually high failure rates were being reported. However, more than 20k devices were implanted in people throughout the country by then. According to NorthJersey.com, "The defect was linked to the use of dissimilar metals in neck and stem components that are anchored into the femur. Corrosion of the metals released toxic substances into the blood stream and caused muscle, tissue, and bone deterioration," lawyers said. The poisoning of the blood from chromium or cobalt is also referred to as Metallosis.

Chris Janish, CEO of MTS, commented on the recent $1 billion Stryker settlement, "The Stryker Hip Settlement comes as no surprise with the highest default rates of any of the metal-on-metal hips. The lawyers worked very hard and expeditiously to secure the largest base hip award in history. However, cases without revisions were not included in the settlement and we urge any remaining patients who have not retained legal counsel to do so immediately in order to qualify for up to $300K in settlement amount per the Stryker recalled hip implant."

The $1 billion settlement is expected to provide plaintiffs an award of $10K to $600K for serious complications including post-operative infections, requirement for further surgeries, hip dislocations, femur fractures, heart attacks, strokes, and lost wages. There are over 3,000 people who now must decide whether or not to accept a share of the $1 billion settlement, because the agreement requires 95% of the plaintiffs to sign on, otherwise Stryker can walk away from the settlement. MTS expects that the settlement will be approved in the upcoming months; however, disbursement of funds is not expected until mid-2015.

Wright Metal-on-Metal Hip Implant Lawsuit Filings Continue to Increase, Says Lawsuitsettlementnews.com

LITTLE FALLS, N.J., Oct. 29, 2014 /PRNewswire/ -- MT Services LLC, a Lawsuit Settlement News Reporting Company which operates lawsuitsettlementnews.com, announced today a primary focus on assisting plaintiffs who have suffered with complications from Wright Hip products. According to an updated Case List issued September 15, 2014, approximately 800 claims have been filed involving individuals who have dealt with complicationsrelated to the all-metal design of Conserve hips from Wright Medical Technology, Inc. The complications that may arise include metallosis (metal poisoning), tissue necrosis (death), loosening and other serious problems, and premature device failure. The filings involving these metal-on-metal hip replacements continue to grow in size and awareness, and the cases are underway in a multidistrict litigation in U.S. District Court in the Northern District of Georgia.

The first bellwether trial could begin as early as March 2015. The plaintiffs involved have had Wright Conserve hips as well as Wright Profemur hip replacements, and according to Drug Watch, "The complaints allege that the devices release high levels of metal particles in the blood that can cause loosening and device failure because of Wright's faulty metal-on metal design." Wright Medical Technology, Inc. disclosed in a regulatory filing that over 800 product liability claims relating to their Conserve hip products have been filed in state and federal courts throughout the U.S.

Chris Janish, CEO of MTS commented on the Wright Litigation, "Clearly with Wright disclosing that they are fighting over 800 lawsuits relating to their hip products, this litigation is shaping up to look like many other metal-on-metal hip litigations that we have recently come across. We urge patients with these implants to see doctors to see if they are having elevated blood poisoning from the metal components and if so to seek legal counsel immediately at the first finding of this. Time to file lawsuit claims against the manufacturer could be limited in some jurisdictions."

Although these cases are recent and growing, Wright Medical is not new to lawsuits. According to Drug Watch, an investigation had started in 2007 and the company was sued by the federal government for "questionable business practices involving bribing doctors to use their products." Wright Medical agreedto pay $7.9 million in fines in 2011 as an avoidance to admit any misconduct. Wright had also settled two Profemur lawsuits in 2013 just before they were set to go to trial. According to Drug Watch who referenced a report from the Australian National Joint Registry, "1 in every 9 patients who received a PROFEMUR Z stem has been forced to undergo revision surgery due to device failure. Complications such as corrosion, femoral neck fracture and fretting were reported."
