da Vinci Lawsuit Settlement News Update: Intuitive in Settlement Talks with Select Private Claims Prior to Entering Mass Tort Litigation, Says Lawsuitsettlementnews.com Website

SUNNYVALE, Calif., Sept. 4, 2014 /PRNewswire/ -- MT Services LLC, a Lawsuit Settlement News Reporting Company, which operates a lawsuit help center: lawsuitsettlementnews.com, reported today that no global settlement is on the horizon, but claims are being reviewed prior to mass tort litigation with possible settlements on the table privately, according to sources close to MTS. Intuitive Surgical Inc., parent company of the da Vinci Robot, took a $67 million "write down" in product liability litigation costs for its malfunctioning components, the Monopolar Curved Scissors (MSC) and MSC Tips, involving the robot litigation. However, this does not mean that Intuitive will accept liability or begin to settle cases in bulk in the near future.

Several complications have arisen from the da Vinci Robot system, such as: lacerations to internal organs including intestines, burns to internal organs and blood vessels, excessive bleeding, nerve damage, severe bowel injuries, punctured blood vessels or uterus, various vaginal injuries, and even death.

In one case involving a Rutherford County Tennessee woman, she has filed suit against Intuitive Surgical for severe and permanent personal injuries after undergoing a robot-assisted hysterectomy. She stated that she suffered a postoperative pelvic abscess during the procedure, which required an extended hospital stay and catheterization. Her da Vinci hysterectomy lawsuit was filed in the U.S. District Court in the Northern District of California. With over 400k surgeries performed each year, numerous other lawsuits have been filed against Intuitive Surgical in U.S State and Federal Courts. Sources believe the injuries are significant and could result in large settlements down the road. MTS is urging patients that have had complications from a da Vinci robot surgery to seek immediate free legal consultation from a da Vinci lawyer or law firm.

Chris Janish, CEO, commented on direction of the Intuitive Litigation, "Our sources close to this litigation believe that Intuitive will eventually agree to a large settlement to resolve all their claims at some point down the road. However, at the current junction of the case -as goes in many mass tort litigations- we are being told the company is attempting to settle private claims today prior to them going into the MDL. This serves two purposes, one that the plaintiff gets paid today, and two the company is able to settle many claims at discounted values. However, it seems much of the discussions are very preliminary in nature and as in any mass tort litigation, some plaintiffs could end up receiving no compensation whatsoever if Intuitive is successful in defending themselves."
