Fresenius Medical Care, the maker of GranuFlo and NaturaLyte, is now the subject of FDA investigations as to whether Fresenius violated any federal regulations by failing to inform patients of a potentially dangerous risk associated with these products, according to the NewYork Times. The dialysis market is a billion dollar industry, providing dialysis for over 100k people in the U.S. alone. Fresenius is considered a major player in the dialysis market.

FDA Recall of GranuFlo and NaturaLyte Products

In March of 2012, The U.S. Food and Drug Administration issued a recall of GranuFlo and NaturaLyte products, which the FDA has now declared as a Class I Recall. A Class I Recall is the most serious type of recall for products that indicate that “there is a reasonable probability that the use of or exposure to a violating product will cause serious adverse health consequences or death.” As a result of the recall, Fresenius Medical Care voluntarily changed the labels on its GranuFlo and NaturaLyte products. However, the recall has not removed the dangerous products from the market and many risk factors still exist.

Serious side effects include the following:

  • Heart attack
  • Sudden cardiac death
  • Cardiopulmonary arrest
  • Cardiovascular death
  • Stroke

GranuFlo and NaturaLyte Lawsuits and MDL

According to Drug Watch, over 1,800 cases against Fresenius Medical Care Inc. have been consolidated into multidistrict litigation (MDL) under U.S. District Judge Douglas P. Woodlock in the District of Massachusetts. The first bellwether trial is to begin on January 11th, 2016, with the second trial to start on February 16th, 2016 (In re: Fresenius GranuFlo/NaturaLyte Dialysate Litigation, MDL No. 2428).

Fresenius Medical Care Reaches $250MM GranuFlo Settlement

In February of 2016, Fresenius Medical Care reached a $250 million agreement in principle to settle claims against them over their dialysis drugs, GranuFlo and NaturaLyte. According to sources, the settlement amount will be $250 million providing that 97% of the plaintiffs agree to the terms of the deal by July of 2016, and the funding will be provided in August of 2016.

According to the Fresenius site, they’ve stated that “Insurers will fund the settlement amount with $220 million,” and therefore, “the company expects a pre-tax charge of $60 million from the settlement and other costs to finalize this matter.”
