Mirena IUD - Mirena Manufacturer, Bayer Healthcare Pharmaceuticals, along with strategic marketing partners, originally marketed Mirena as an innovative form of contraceptive that would make you “look and feel great,” and help you to be “more intimate (with your partner).” However, it seems that Bayer failed to warn its users of the potentially serious side effects of the drug.

FDA Warning - In 2009, The FDA sent Bayer an official warning letter, with their concerns with the drug. The FDA's warning letter essentially states that claims of Mirena, as opposed to other forms of contraception, will increase intimacy, romance and, by implication, emotional satisfaction – "misleadingly overstating the proven efficacy of Mirena." The letter further expressed concerns that Bayer’s marketing of Mirena omitted certain information regarding the potential side effects of Mirena.

Mirena Litigation Update

A recent court order was issued regarding the Mirena litigation that directed both parties to select five cases each to possibly be included in the Second Deposition Pool. Additionally, five filed cases will then be selected at random, according to Virtual-Strategy.com. The Second Deposition Pool is for the Mirena Intrauterine Device (IUD) multidistrict litigation (MDL) in the U.S. District Court Southern District of New York (In re: Mirena IUD Products Liability Litigation, MDL No. 2434).

Yaz, Yasmin, and Ocella - Bayer Healthcare Pharmaceuticals is the manufacturer of Yaz and Yasmin and the products were initially marketed as having more benefits and less side effects than the traditional “pill.” However, many younger women who began taking it saw that the side effects were actually more serious and not properly disclosed.

Settlement Reached- Bayer Healthcare Pharmaceuticals settled 3,500 suits for an average settlement amount of $214,000 per case.

$57 Million Yaz Settlement Reached in August 2015 - Bayer HealthCare Pharmaceuticals Inc. settled for $56.9 million, for thousands of claims from women victims who took the company’s birth control products Yaz, Yasmin and Ocella. The settlement was announced August 3rd. The women involved suffered serious and life-altering side effects. The lawsuits started being filed in the late 2000’s, and since the initial filings, more than 12,000 people came forward with claims against the company regarding the birth control products in question. The settlement will resolve lawsuits pending in a multidistrict litigation in federal court in Illinois (MDL 2100), as well as claims filed in California, New Jersey, and Pennsylvania.

NuvaRing - NuvaRing is considered to be a 3rd Generation Birth Control product designed for young women for direct insertion in the vagina, in place of having to take “the pill” every day. The “Ring Design” was marketed as a safe alternative, however, by 2013 over 1,000 lawsuits had been filed against NuvaRing Manufacturers: Merck Pharmaceutical, Schering-Plough and Organon (the latter 2 were acquired by Merck).

Settlement Reached - Bloomberg News reported in early 2014 that a $100MM settlement had been reached between NuvaRing Manufacturer, Merck & Co., and the plaintiffs for an estimated $100MM, or an average of about $58K for each case. The settlement is less than the $200K average that was obtained in the Yaz Birth Control Pill case, but only because the plaintiffs were having a much harder time proving that the “ring” device was the root of the side effects. In fact, in 2013 a New Jersey Judge threw out seven NuvaRing cases before they were set to go to trial due to causation issues raised by defense counsel. Prior to attempting further litigation on the several thousands of cases still pending in State and Federal Courts, both parties agreed to an acceptable settlement.
